    Terms of Service

    These Terms govern your use of the ScrapeTheMap desktop software and related websites/portals.

    ScrapeTheMap (the “Software”) is desktop software licensed by Leadomator LLC (“Company”, “we”, “us”, “our”). By downloading, installing, activating, or using the Software and our websites/portals (collectively, the “Services”), you agree to these Terms of Service (the “Terms”). If you do not agree, do not use the Services.

    1) Who we are & how to reach us

    2) What the Software does (scope)

    The Software provides local, user-controlled tools to collect, transform, and export information that you lawfully access on the web, including online maps. Processing occurs on your device; we do not receive your extracted target data unless you choose to send telemetry or support files.

    3) License grant

    Subject to payment and compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to install and use one copy of the Software per license seat for your internal business or personal use.

    You may not
    • Sublicense, resell, rent, or lend the Software;
    • Reverse engineer/decompile except where permitted by law;
    • Bypass license checks, usage limits, or technical protections;
    • Remove proprietary notices.

    4) Your responsibilities (critical)

    • Obey laws & site terms. Only access targets as permitted by law and by those targets’ terms (robots rules, API/licensing, usage policies).
    • No circumvention. Do not bypass logins, paywalls, CAPTCHAs, IP blocks, rate-limits, or other access controls; do not facilitate such bypassing.
    • API-first. Where a provider requires an official API (e.g., Google Maps), you must use that API and comply with its license. The Software does not grant rights to third-party data.
    • No restricted data. Do not collect special-category personal data (health, biometric, children’s data, etc.) or any personal data without a lawful basis and required notices/consents.
    • Respect IP/database rights. Do not copy or extract substantial parts of protected databases or content beyond what is permitted.
    • Export/sanctions compliance. You, your end-use, and your customers comply with U.S./international export and sanctions rules.

    5) Prohibited uses (examples)

    • Encouraging or enabling breach of third-party terms or contracts;
    • Violating privacy, publicity, or consumer-protection laws; harassment or spam;
    • Training models or republishing content in violation of a source site’s license;
    • Benchmarking or building a competing product by copying our code, UI, or rules;
    • Any use that materially degrades or attacks a target site (excessive load, DoS, etc.).

    6) Independence from targets

    We are not affiliated with target sites and do not authorize access beyond what they permit. If a target notifies us that specific uses violate its terms, we may remotely disable related connectors/patterns (see Section 10).

    7) Telemetry, logs & support data

    • By default, the Software does not transmit your extracted target data to us.
    • Optional diagnostics (if enabled) may include OS/version/error traces and are not intended to include target payloads.
    • If you send logs/screens to support, you are responsible for redacting sensitive information.
    • Our website/portal uses cookies/analytics per our Privacy & Cookie notices.

    8) Payment, taxes, refunds

    • Pricing: one-time license unless stated otherwise; taxes/VAT may apply.
    • Refunds: unless expressly advertised, all sales are final.
    • EU/UK consumers: consent to immediate digital delivery and acknowledge you waive the 14-day withdrawal right once delivery/activation begins (a separate checkbox may be presented at checkout).

    9) Notices, takedowns & data deletion requests

    If we receive a credible notice (copyright, database right, terms-of-use complaint) about specific target patterns or outputs, we may request information, require you to cease the activity, and/or push an update that disables the pattern (see Section 10). You are responsible for deleting disputed data in your possession and for responding to requests addressed to you.

    10) Updates; compliance rules; remote disable

    We may ship updates (bug fixes, security patches) and rules lists that disable/modify modules, connectors, or scraping patterns for compliance/safety. We may remotely deactivate specific patterns or license keys in case of suspected breach or legal risk.

    11) No warranties

    TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED (INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND NON-INTERFERENCE). We do not warrant compatibility with any particular website/API or with changes those sites make.

    12) Limitation of liability

    TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION, OR REPUTATIONAL HARM. Our aggregate liability for all claims is limited to the amount you paid for the license giving rise to the claim. Non-waivable consumer rights remain unaffected.

    13) Indemnification

    You will defend, indemnify, and hold harmless the Company from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Software; (b) your violation of these Terms; (c) your violation of laws or third-party rights; or (d) any dispute with a target site about your access, collection, storage, or use of data.

    14) Third-party services & APIs

    Third-party terms govern their content and APIs. For providers that prohibit export/extraction (e.g., certain map services), you must comply and use approved APIs where required. Convenience templates in the Software do not grant rights to third-party data.

    15) Term, suspension, termination

    These Terms start when you first download/install or use the Software and continue until terminated. We may suspend or terminate your license (and disable keys) for material breach, including attempts to circumvent technical protections. Upon termination, you must uninstall and cease use.

    16) Governing law; venue; arbitration; class waiver

    These Terms are governed by the laws of the State of Wyoming, USA (conflict rules excluded). Binding arbitration: any dispute will be resolved by confidential arbitration administered by the American Arbitration Association (Commercial Rules). Seat: Cheyenne, Wyoming; language: English. Class actions are waived. Judgment on the award may be entered in any court of competent jurisdiction.

    17) International users & consumer rights

    If you are a consumer in a jurisdiction providing non-waivable protections (e.g., EU/UK/AU), those rights remain in force and these Terms apply only to the extent permitted by law.

    18) Changes

    We may update these Terms for product, legal, or regulatory reasons. If changes are material, we will post the updated date and, where feasible, provide notice via the website or in-app. Continued use after the effective date constitutes acceptance.
